Any exercise of the opt out must be fully justified in each case as prescribed by the REACH text.<\/span><span style=\"font-size:100%;\"><\/p>\n<p><\/span><span style=\"font-family:sans-serif;font-size:100%;\">the criteria to opt-out of joint submission?<\/span><span style=\"font-size:100%;\"><br \/><\/span><\/p>\n<ol>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">Disproportionately costly to submit the information jointly.<\/span><\/li>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">Disclosure of relevant information (Protection of confidential business information)<\/span>.<\/li>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">Disagree with Lead Registrant<\/span>:<\/li>\n<\/ol>\n<ul>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">test data is not appropriate to his product\u201fs specific application.<\/span><\/li>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">Data proposed for the joint registration is of an unsatisfactory standard, and does not wish to compromise his reputation by being associated with what he sees as inferior material.<\/span><\/li>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">A registrant might consider the data proposed for use in the joint registration to be of an unnecessarily high standard<\/span>.<\/li>\n<\/ul>\n<p><span style=\"font-family:sans-serif;font-size:100%;\">To take into account:<\/span><span style=\"font-size:100%;\"><br \/><\/span><\/p>\n<ul>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">The REACH Regulation does not define \u201cdisproportionate\u201d costs, registrants relying on this ground to opt out should provide sufficient explanations in their registration dossiers.<\/span><\/li>\n<li><span style=\"font-family:sans-serif;font-size:100%;\">The case must be based on the commercial loss which would be sustained if such CBI were disclosed by joint registration.<\/span><\/li>\n<li>Dossiers submited under the opting out provisions will be prioritised by ECHA during the compliance checking.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Registrants are allowed to opt out from the joint submission under specific conditions.
